By bidding in WR Auction Gallery Inc.'s auction, you agree to be bound by these terms and conditions.

WR Auction Gallery Inc. reserves the right to change the terms of sale and any such changes shall become part of the conditions of sale.

CONDITION AND AUTHENTICITY OF ITEMS

​

All items are sold AS IS and WHERE IS. Descriptions and condition reports (verbal and written) are considered knowledgeable opinions and are to be taken for informational value only, and are not to be taken as warranties or guarantees of any kind. In no event shall WR Auction Gallery Inc. nor its consignors be responsible for the correctness of description, genuineness, attribution, provenance, authenticity, authorship, age, condition, manufacturer, materials, completeness, estimate of value, or any other feature of the items being sold. Please note that all measurements and weights provided by WR Auction Gallery Inc. are approximations. The buyer must use the previews to examine all merchandise and to judge whether or not the descriptions, photographs, and any other information provided by WR Auction Gallery Inc. are accurate.

FIRST TIME BUYERS

​

First-time buyers are required to submit a copy of their id and a copy of the back and front of their credit card. They are also required to fill out and submit the registration form.
 
 
 
BIDDING

 

By placing a bid, you signify that you have examined the item(s) as fully as you have desired to or that you have chosen not to examine it/them.

 

When you place a bid, you enter into a contractually binding and irrevocable obligation to complete the transaction if you are the 'winning bidder' of that lot.
 
The 'winning bidder' is the person certified to be the highest bidder by the auctioneer, and it includes any under-bidder who is awarded the lot following the failure for any reason of a higher bid as decreed by the auctioneer.
 
Under no circumstances can a bid be retracted after it has been submitted (unless the auctioneer has allowed the retraction).

 

The 'winning bidder' assumes the full risk and responsibility of the property that he/she has purchased, agrees to sign any forms related to confirmation of purchase, and agrees to pay the full purchase price (the hammer price + the buyer's premium).

CONDITION REPORTS

​

The condition of an item is not included in its description. Bidders must request condition reports and additional/detailed photographs directly from WR Auction Gallery Inc. for a particular item or lot number. Condition reports are knowledgeable opinions and are not meant to be warranties and/or guarantees of any kind. Prospective bidders must come to the previews to judge whether or not the condition reports provided by WR Auction Gallery Inc. are accurate.

Condition reports must be requested at least 48 hours before the sale date.

AUCTIONEER'S RIGHTS

 

The decision of the auctioneer is final and cannot be challenged for any reason.
 
The auctioneer has the right to reject any bid and he/she shall have the sole and final discretion either to determine the successful bidder or to re-offer and resell the article in the case of a dispute.
 
Potential bidders may be turned away at the sole discretion of the auctioneer.
 
The auctioneer may reopen an item if he/she determines an error.
 
 
 
PAYMENT

Acceptable methods of payment include cash, good check, money 
order/bank check, wire transfer. Credit cards (Visa, Mastercard, American Express, Discover) will be accepted if the total invoice balance does not exceed $1500. An additional fee will be added to all credit card payments. Total invoice balances that exceed $1500 must be paid with an alternative payment method.

WR Auction Gallery Inc. is not responsible for any fees/charges associated with wire/bank transfers. The buyer is responsible for all fees/charges related to his/her wire/bank transfer(s).

​

WR Auction Gallery Inc. reserves the right to hold items paid by check until the check has cleared.

​

No merchandise will be released until payment has been received in full.

​

Please note that we do not accept payment methods that have not been listed above.

PERMISSION TO CHARGE

​

If the winning bidder has not paid for his/her item(s) within 7 business days of the auction sale, WR Auction Gallery Inc. will charge the winning bidder's credit card on file for his/her total invoice balance.

UNPAID FOR AND/OR UNPICKED UP ITEMS

 

All item(s) shall be paid for by the 'winning bidder' within seven (7) business days of the auction sale. If the item(s) are not paid for within 7 business days of the auction sale, WR Auction Gallery Inc. reserves the right to do any of the following: cancel the sale, sell the item(s) to another buyer, charge late/storage fee(s), automatically charge winning bidder's credit card on file for total invoice balance.
 
WR Auction Gallery Inc. may prohibit delinquent buyers from participating directly or indirectly as a bidder or purchaser in any future sale(s). 
 
If the 'winning bidder' has paid for the item(s) but has not picked up his/her item(s) within fourteen (14) business days from the auction sale, WR Auction Gallery Inc. will charge a storage fee of $10 per day on each item (unless the 'winning bidder' has contacted WR Auction Gallery Inc. and WR Auction Gallery Inc. has agreed to make an exception for the purchaser). WR Auction Gallery Inc. will not be responsible for any loss, damage, or theft for any paid goods left in the company's possession after fourteen (14) business days from the auction sale.

If the 'winning bidder' or purchaser has paid for his/her item(s) in full but has not picked up his/her merchandise within one month (including business and non-business days) of the auction sale, WR Auction Gallery Inc. has the right to cancel the sale and will NOT refund back the payment to the 'winning bidder' or purchaser.
 
 
 
SHIPPING/HANDLING/PACKING

​

It is the buyer's responsibility to arrange and pay for the pick up/shipping/handling/packaging/insurance of purchased item(s).

​

If the buyer chooses to have a third party (i.e. shipper, person other than buyer) pick up his/her purchased item(s), the buyer must send an email to WR Auction Gallery Inc., which clearly states that the buyer is authorizing the third party to pick up those item(s).

​

Whether the buyer decides to pick up the purchased item(s) directly from the premises of WR Auction Gallery Inc. or whether the buyer arranges for a third party (i.e. shipper or person other than the buyer) to pick up the item(s), WR Auction Gallery Inc. will not be responsible for item(s) that have left its premises.

​

Shippers assume all responsibility for the purchaser's item(s) that have left the premises of WR Auction Gallery Inc.

​

WR Auction Gallery Inc. may recommend shippers and/or truckers to its buyers but WR Auction Gallery Inc. is not responsible for the actions of those shippers and/or truckers and WR Auction Gallery Inc. does not provide warranties or guarantees of any kind for those shippers and/or truckers.

​

Certain item(s) may not be shipped interstate or internationally because of the materials that the item(s) are made out of. It is the buyer's responsibility to research and be aware of all pertinent laws before bidding on an item.

TAXES

​

All purchases are subject to New York sales tax unless the purchaser possesses a current resale certificate. If the purchaser does possess a current resale certificate, he/she must email/fax to WR Auction Gallery Inc. a copy of his/her resale certificate and he/she must fill out and submit the ST-120 form (resale certificate form).

​

International bidders are responsible for all taxes and fees for item(s) shipped outside of the US.
 
 
 
WITHDRAWAL OF ITEM(S) FROM AUCTION

​

WR Auction Gallery Inc. has the right to withdraw any item at any time for any reason and holds no liability for the removal of this item.

​

​

BUYER'S PREMIUM

​

A buyer's premium of 29% will be added to the hammer price of each lot. The buyer's premium is the same for online bids, phone bids, and absentee bids.

​

​

RESERVE

​

All items may be subject to a reserve, which is predetermined by WR Auction Gallery Inc. prior to bidding. The reserve is the confidential minimum hammer price at which a lot will be sold. WR Auction Gallery Inc. may reach these reserves by bidding on behalf of the consignor and may bid up to the amount of the reserve by placing consecutive bids for a lot or by placing bids in response to other bidders. The auctioneer has the right to withdraw the item from the sale if the reserve has not been met.

LOSS OF INTERNET CONNECTION WHILE AUCTION IS IN PROGRESS

 

In the unlikely event that WR Auction Gallery Inc. loses its internet connection, it reserves the right to cancel the remainder of the auction.
